Upfront Sales Packs

Portal terms of use

Last updated . These terms apply to the portal at portal.upfrontsalespacks.com. The website terms apply to this website.

The portal is a place to gather, store and share the documents and facts a buyer will ask for about your home. These terms are written to be read. By creating an account you accept them.

Who we are

The portal is operated by the operator of Upfront Sales Packs ("we", "us"). You can contact us through the contact form.

What the portal is, and is not

The portal gives you a checklist of the items that make up an upfront sales pack, guidance on how to get each one yourself from the official source, private storage for your documents, and, when you choose, a way to share them with named people for a time you set.

We are not a law firm, licensed conveyancer, estate agent or surveyor. We do not market property, introduce buyers, negotiate, give legal, financial, valuation or tax advice, prepare contracts or transfers, or lodge applications at HM Land Registry. The guides explain in general terms where a document comes from and what it costs; they do not tell you what a document means for your sale. For that, ask your conveyancer. Using the portal does not create a client relationship of any kind.

Your account

You must be 18 or over. Keep your sign-in methods secure and tell us at once if you think someone else has used your account. You are responsible for what is uploaded and shared from your account. We will email you whenever a sign-in method is added or removed.

Your pack and your documents

Your pack belongs to you. Upload only documents you are entitled to share, about a property you own or are authorised to deal with. Do not upload identity documents or anything about your health; we do not need them. Documents must be genuine: do not alter an official document. We store your documents privately and do not read, sell or use them for anything other than running the service for you.

You can delete any document at any time, and download your documents before your pack is deleted. Packs are kept for the periods in the portal privacy notice, with reminders before deletion.

Sharing

When sharing is available, you choose each person who may see your pack and for how long. You are responsible for choosing them. People you share with may use the pack only for the sale of your property and must not copy or pass it on beyond that purpose; their access is logged and can be ended by you at any time.

Free use

The checklist, the guides, your uploads and your pack are free. Official bodies and third parties charge their own fees for some documents, which you pay to them directly if you choose to get a document yourself.

Asking us to do something

Where an item offers "Ask us to do this", choosing it records your interest and does not cost anything or create an order. We will email you to confirm the price, what we would do and how long it would take. Nothing is charged unless you then agree in writing to a price. When paid services are introduced, their own terms will be shown before you pay, including your cancellation rights.

Supplier suggestions

Where the portal suggests local suppliers, each is a paid referral: if you choose a supplier and send them your request through the portal, that supplier pays us a flat fee. The fee is the same for every supplier in a category, is shown to you in pounds before you choose, and does not depend on whether you go ahead or what you pay the supplier. Nobody can pay to appear higher, and your request goes only to the supplier you choose. Conveyancers and solicitors are not charged per referral. We check suppliers' registrations before listing them and yearly, but we do not inspect their work. Any contract for their services is between you and them.

Acceptable use

Do not use the portal to break the law, to upload material you have no right to, to attempt to reach other people's packs or our systems, to upload malicious files, or to send spam. We may suspend an account that does.

Availability and changes

The portal is new and is being built in stages. Features marked as previews or in development may change. We aim to keep the portal available but do not guarantee it, and we will give notice of planned maintenance where we can. We may change these terms; we will tell you before a change takes effect, and continuing to use the portal after that means you accept it.

Our liability to you

We will provide the portal with reasonable care and skill. We are liable for loss you suffer as a foreseeable result of our breaking these terms or failing to use reasonable care, but not for business losses or for loss caused by documents or information supplied by you or by third parties. For the free service, our total liability to you is limited to £500. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited under the law of England and Wales. Your statutory rights as a consumer are not affected.

Complaints

If something has gone wrong, tell us through the contact form. We will acknowledge your complaint within five working days and give you a full answer within eight weeks. If it is about your personal data, the privacy notice explains your right to complain to the Information Commissioner's Office.

Privacy

How we handle your personal data is explained in the portal privacy notice.

Law and jurisdiction

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction, except that if you live in Scotland or Northern Ireland you may also bring proceedings in your local courts.
